. One of the words that has become common in the field of marital problems in recent years is the emotional divorce. In an emotional divorce, although the couple is legally married, in reality the hearts are separated and usually, there are high hatred, and discord between the couple. Emotional divorce, which is caused by specific personal, social, economic and cultural causes, itself result in other problems such as family disputes, psychological pressures, trauma and litigation, and formal and legal divorce. This study sought to find out whether emotional divorce is mentioned in jurisprudential sources or not. In this article with a study conducted in jurisprudential sources revealed that the word emotional divorce and in other words emotional separation, although is not in jurisprudential sources, in different jurisprudential chapters related to divorce and separation of couples can be finded words related to divorce. These words are: hatred in the relationship of the couple (including hatred of the husband from the wife, hatred of the wife from the husband or hatred of each spouse with the other), incontinence, schism, malice and the concern of jurisprudence in all these cases is to correct the existing relations in emotional divorce. The research method is library in terms of collection and descriptive-analytical in terms of research method.
